1. Acceptance of Terms

Welcome to Truffle. By accessing or using the Truffle mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Truffle ("we," "our," or "us").

2. Description of Service

Truffle is a curated AI cinema streaming platform that provides access to AI-generated short-form cinematic content. The service allows users to:

• Browse and watch video content
• Create and manage user accounts
• Discover new content through curated feeds

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that:

• You are at least 13 years old
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws

If you are under 18, you confirm that you have obtained parental or guardian consent to use the App.

4. Account Registration

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password confidential and secure
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

5. User Conduct

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Use automated systems (bots, scrapers) to access the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Share your account credentials with others
• Impersonate another person or entity
• Collect or harvest personal information of other users

6. Content and Intellectual Property

6.1 Our Content

All content available through the App, including videos, text, graphics, logos, and software, is owned by Truffle or its content providers and is protected by copyright, trademark, and other intellectual property laws.

6.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes. This license does not include:

• Downloading or copying content (except as technically necessary for streaming)
• Distributing, broadcasting, or publicly performing content
• Commercial use of any content
• Creating derivative works

6.3 Trademarks

TRUFFLE and the Truffle seal logo are trademarks of Truffle. You may not use these marks without our prior written permission.

7. Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Third-Party Services

The App uses third-party services including Firebase (Google) for authentication and Bunny CDN for content delivery. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation

We do not warrant that the App will meet your requirements or that defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUFFLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Business interruption
• Personal injury or property damage
• Loss of goodwill or reputation

OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Truffle and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of applicable laws

12. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Request by law enforcement or government agency
• Discontinuation of the service
• Unexpected technical issues

Upon termination, your right to use the App will immediately cease. You may also terminate your account at any time by contacting us or deleting the App.

13. Dispute Resolution and Arbitration

13.1 Binding Arbitration

Any dispute arising from these Terms or the App will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

13.2 Class Action Waiver

You agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13.3 Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date
• Sending an email notification (for significant changes)

Your continued use of the App after changes constitutes acceptance of the modified Terms.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Truffle regarding the App and supersede all prior agreements and understandings.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17. Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

18. Export Control

The App may be subject to U.S. export control laws. You agree to comply with all applicable export and re-export restrictions and regulations.

19. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, pandemic, or failures of third-party services.
